What is the regularization decree?
Royal Decree 316/2026, published in the Official Gazette (BOE) on April 15, 2026, establishes an extraordinary mechanism for foreign nationals in an irregular situation in Spain to obtain a residence and work permit.
This is Spain's first extraordinary regularization since 2005. Applications must be filed within a limited window that closes on June 30, 2026.
DT5 — International protection applicants
Transitional Provision Five is aimed at individuals who filed an asylum or international protection application in Spain before January 1, 2026. If your application was denied, rejected, or is still pending, you may use this pathway to obtain residence.
DT6 — Extraordinary settlement
Transitional Provision Six creates an extraordinary settlement pathway for individuals who have been continuously residing in Spain for at least 5 months. You must meet at least one of the following additional conditions:

Having an employment contract, job offer, or intention to work as an employee or self-employed.

Having minor children, children with disabilities, or dependent family members in Spain.

Being in a situation of vulnerability certified by a social entity registered in the Immigration Collaborators Registry.

Not hold any current residence or stay permit.

No criminal record in the last 5 years.
- ✓
Have a passport, registration certificate, or travel document (even if expired).
⏰ Deadline
The window for filing applications opens with the decree's publication and closes on June 30, 2026. Late applications will not be accepted.
Provisional work authorization
One of the most significant features of the decree: from the moment the application is filed, the person receives provisional authorization to work. There is no need to wait for the final decision.
Administrative fee
Payment of the administrative fee (form 790-012) must be proven before filing the application, as required by Order PJC/617/2025. The fee is paid directly to the Administration and is not included in legal service fees.
